Stone Creek Village Board Meeting Minutes

April 29, 2012

I. Call to order

The Stone Creek Village Board Meeting was officially called to order at 1:00pm. Board members present Tanya Owen, Michele Babbitt, Board member present via phone conference were; Fred Scarpello, and Brice Gadjoro.

II. Financials

a. Current financial standings were discussed, including the amount of monthly dues collected in the month of April

b. Owners with current balances were discussed. If an owner is 60 days behind in monthly association dues a lien will be filed within 10 business days if balance is not made current or payment arrangements are not made.

c. Current liens were reviewed, and will be updated if account is not brought current in May.

III. Projects

a. 6008 N. 167^th Plaza has exterior issues which were addressed in order to allow home to close. The following items will be completed on or before May 31, 2012 as part of an agreement made with the owner: low lying area by driveway needs to be repaired, hole into the fire closet visible from the exterior, siding panel in the back of the home which is waving, crack in the driveway. Estimates have been given out for all the work and are requested to be returned by May 4^th for full consideration.

b. 6002 N. 167^th Plaza has interior damage from a roof leak. The roof has been repaired. Interior repair estimates will be collected by May 4^th and the board will review at that time.

c. 16702 Crown Pointe Plaza had previous damage from a pigeon that nested in the attic, due to a hole on the exterior of the home. The hole has been repaired. Estimates for debris and waste removal will be collected by May 4^th and the board will review at that time.

d. Siding: the following addresses have reported additional siding damage; 16762 Arcadia Plaza, 16754 Arcadia Plaza, 5956 N. 167^th Terrace Plaza and 5924 167^th Plaza. Estimates have been collected and the board will be making a decision on a vendor to have areas repaired by the second week in May.

IV. Architectural/Landscape requests

a. The Board reviewed one pending request that had recently been submitted to add stairs to the back deck of 16774 Laurel Plaza. The request was approved. Beth with PJ Morgan will notify the owner of the approval.

V. Lockwood Development

a. Lockwood Development has completed the 12 plex and is wanting to arrange the transition of the units into the HOA. The board decided that it would be best to set up a meeting with Lockwood Development. The Board will also work on getting a checklist for the meeting of items that need to be repaired or addressed prior to the transition meeting.

VI. Street Signs

a. There is at least one missing street sign in the community, the Board will be getting estimates on replacing the sign and also doing inventory on any other signage to see if the signs can be added into the budget for this year.

VII. Annual Meeting

a. It was brought up for discussion of possibly moving the annual meeting date earlier in the year to accommodate the budget ratification meeting and to appeal to more homeowners schedules. The board agreed to look at possible dates in the month of August.

VIII. Adjournment-

I. Call to order

The Stone Creek Village Annual Meeting was officially called to order at 6:51pm, when a quorum was reached. Board members present Tanya Owen, Christina Elf, Fred Scarpello, Michelle Babbitt, and Brice Gadjoro. Members present at the meeting were; Alex and Karen Bloemer, Jason Brown, Heather Clancy, Andy Danielson, Adaela Dostal, Kate Koerten, Travis Rozeboom, and Anastasia Treantos.

II. Elections

a. Nominations from the floor-no nominations

b. Ballot vote to elect 5 Directors to the SCV Board-waiting for quorum, quorum met at 6:51.

III. Dogs

a. Amendment dated August 2006 removed the weight limit.

i. Ballot vote to move forward in the process of changing the Bylaw to add a weight limit or leave as is. Amendment change would require 67% of owners to agree.

ii. Travis commented that as long as people take care of the waste and pay for damages to the lawn.

iii. One homeowner asked a question about having her dog of the leash while throwing a frizby-must be on a leash on SCV. There is a City leash law and Bylaws also require dogs be leashed.

iv. Asked to provide direction, there are concerns about renters

IV. Open floor for discussions

a. Damage to air conditioner on Brian’s unit. Tanya said to submit the claim and SCV HOA will cover as claim is closed.

b. Travis Rozeboom-What lawsuits are still pending? Safford and 2008 Insurance Proceeds. Much work on this, nondischargeability claim for Joel Goodmans claim of bankruptcy. Fees generated on that matter $26,000 of which only $8,500 has been applied Dave will be paid a % on the recovery of monies

c. Midwest issue-the work orders will be sent out to each unit to verify what work has been done and what still needs to be completed. Once a dollar amount is calculated Dave will communicate with Midwest.

d. Exterior lights-are in the process of being replaced.

e. Travis Rozeboom-is a snow fence being considered? Board will check on the snow fence

f. Fire suppression on the Crown Point Building-16754 damaged by broken pipes. U.S.Bank owns and hasn’t done anything to fix it. Board has taken care of fire suppression system. Report to fire Marshal that it has been fixed. Trying to get U.S. Bank to fix the unit. Giving them 10 days to start remediation before the HOA fixes it.

g. Travis Rozeboom-FHA approval done? Beth has to check with Ralph Marasco to see if it has gone through yet.

h. Alex B. asked about the 12-plex-declined request to put in cedar balcony, said they would price them at 105 or 110 and should increase with the market

i. Lake should help property values

j. Roof damage is part of Triton lawsuit and repairs are currently on hold pending outcome.

k. Concrete lawsuit stalled. Working with snow removal company to reduce further damage.

l. Replacing flowers/landscaping will be made as soon as funding is available.

V. Budget

a. Dues status

i. Have collected back dues from some individuals

ii. Have been using some of the extra to pay down legal fees

iii. One unit was forclosed on and won’t collect the $3,000 in back dues, Wells Fargo forclosed and hoping that they will pay the dues for their unit

iv. Working through what to do with people that don’t pay their dues regularly

b. Review of proposal for 2012

i. Based on $11,200 in revenue if everybody pays

ii. Boards goal is 10-15% each month for cash reserve

iii. Board is recommending that dues stay at $160 per month

iv. Will keep a close eye on snow removal expenses

c. Meeting in mid to late January to ratify budget

VI. Approval of minutes from last meeting

a. Fred motioned, Travis second minutes approved

v Financial

§ Current balance

We asked Beth to obtain 2 separate accounts for cash flow and insurance proceeds

Beth will contact PS to see what money they are holding back. PS did a $4k transfer to PJ Morgan at the end of last month.

We need to know from PS: payable amount, operating account balance, and any amount holding back.

§ Dues status (who’s behind & totals)

Very long list due to transition. Beth will set up to have dues ACH by the 2^nd of each month; homeowners have 10 days to pay and on the 11^th, late notices will be mailed out then liens will be placed if no payment has been made. Next month of nonpayment, foreclosure proceedings begin. Carlos Telez-Mendez most in arrears. Beth to follow up with homeowners.

Thinking of ways to cover grounds to eliminate weeds, Architectural Committee, Jason Brown, Dustin’s neighbor. We will ask if he will join then do a proposal on what we need.

Additional $3000 to fix downspouts, wavy siding.

2 electrical meters used for construction. Costing HOA $35 month.

§ 3^rd party review (Hahn) - Fred

Fred talked to him and they are using materials as specified. Final report should be received shortly.

v Lightning strike

$350 has been paid. No findings of any damage on roof.

§ Forrest AC repair approval

Beth will ask FB why approved when the covenants say that it is not covered. IE: it is the homeowner’s responsibility because that AC covers only their dwelling. Beth to investigate further.

v Ahern

$1100 paid, another invoice for $890. Need to get into HUD unit. They will not call Beth back. She will send notice of entry out to them.

v Lisa Vondra - 5923 N 166th Court

§ Leaking windows – HOA responsibility?

No. She will need to contact Marasco if he promised her to fix these. This is an agent and seller issue. Beth to follow up with Lisa.

v Legal – Tanya

Dave has not replied yet. Hoping to see Sue Clark settle

They have been paid. We would like to walk away from this. Need to follow up with Dave on probability of winning.
